When to file a claim

Generally speaking, you should file a claim as soon as you think you have a potentially service-connected disability.

If your claim is granted—the effective date of an award will most likely be the date you filed the claim.
You may reduce your award if you delay filing a claim.

It does not matter how long ago you separated from service.

Do not wait to file your claim until you gather evidence or see a doctor. The VA system is designed to help develop claims, gather evidence, and provide medical evaluations.

How to file a claim

The VA has different forms for different types of claims. It is important to file your claim using the correct form.

To file a claim for a new condition or to file for an increase for an already rated condition use VA Form 21-526EZ

Tips for filling out 21-526EZ

  • Read the instructions included with the form.
  • Fill out all the requested information.
  • Usually, we advise our clients to select the Standard Claim process, not the Fully Developed Claim process. The VA may have a heightened duty to help develop a claim and gather evidence under the Standard Claim Process. While the fully-developed claim process may be faster, the VA may not be required to help develop evidence and that may lead to a denial that is harder to appeal.
  • Be clear but not too specific when describing your disability. For instance, we recommend a veteran file for a “back disability” instead of a specific diagnosis. That way, VA will consider all back problems, not just the one listed.

To file a claim for a condition previously denied by the VA at least one year before use VA Form 21-0995.

This type of claim must be accompanied by new and relevant evidence.

To file a claim for additional benefits for a dependent use VA Form 21-686.
